By accessing or using Protocol Memory ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of the Service, including visitors, registered users, and any future paid subscribers.
2. Description of Service
Protocol Memory is a personal AI memory management tool that helps users maintain continuity across AI conversations. The Service allows you to:
- Create and manage multiple profiles for different contexts
- Store "seeds" (tasks, goals, priorities) and "contexts" (background information)
- Generate structured prompts for AI assistants that include your memory
- Sync your data across devices via cloud storage
- Share public profiles with others (optional)
3. Service Availability & Data
3.1 Service Status
Protocol Memory is a live service that we continuously improve. As with any cloud service:
- Features may be updated, changed, or discontinued with reasonable notice
- Service availability is subject to maintenance and updates
- We strive for high uptime but cannot guarantee uninterrupted access
3.2 Data Responsibility
While we take data protection seriously, you acknowledge that:
- You use the Service at your own risk
- We are not liable for data loss, corruption, or unavailability beyond our control
- We recommend maintaining your own backups of important information
- You can export your data at any time from the Settings page
4. Account Terms
4.1 Account Creation
To use most features of the Service, you must create an account. You agree to:
- Provide a valid email address
- Maintain the security of your account
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorized access
4.2 Account Eligibility
You must be at least 13 years old to use this Service. If you are under 18, you must have permission from a parent or guardian.
4.3 One Account Per Person
You may not maintain more than one free account. Paid subscribers may create multiple accounts within their plan limits.
5. User Content & Privacy
5.1 Your Content
You retain all rights to the content you create in Protocol Memory (profiles, seeds, contexts, etc.). By using the Service, you grant us permission to:
- Store and process your content to provide the Service
- Display your content back to you across devices
- Display public profile content to others (if you choose to make profiles public)
5.2 Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
5.3 Public Profiles
If you choose to make a profile public, you understand that:
- Anyone with the link can view the profile
- Public profiles may be indexed by search engines
- You control what information is made public
- You can make profiles private at any time
6. Subscription Tiers & Pricing
6.1 Free Tier
The Free tier includes:
- 1 profile with all core features
- Cross-device sync
- Prompt generation for any AI
- Data export
6.2 Pro Tier
Pro tier pricing: $9.99/month or $99/year.
- Unlimited profiles (Free tier limited to 1 profile)
- All Free tier features included
6.3 Pricing Changes
We reserve the right to change pricing at any time. Active subscribers will be notified 30 days before any price increase and may choose to cancel before the increase takes effect.
7. Prohibited Uses
You agree NOT to use the Service to:
- Violate any laws or regulations
- Infringe on intellectual property rights of others
- Transmit malware, viruses, or malicious code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Abuse, harass, or harm other users
- Use the Service for commercial purposes without a paid plan (when available)
- Scrape or collect data from the Service without permission
- Impersonate others or misrepresent your affiliation
8. Termination
8.1 Your Rights
You may delete your account at any time from the Settings page. Upon deletion:
- Your profile data will be permanently deleted
- Public profiles will become unavailable
- This action cannot be undone
8.2 Our Rights
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Use the Service in a way that harms other users or the Service
- Engage in fraudulent activity
- Abuse the Service or support resources
9. Disclaimers & Limitations of Liability
9.1 "As-Is" Service
THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2 No Guarantees
We do not guarantee that:
- The Service will be uninterrupted, secure, or error-free
- Data will be accurately stored or retrievable
- Defects will be corrected
- The Service will meet your specific needs
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service

You agree to indemnify and hold harmless Protocol Memory and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.
11. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date at the top
- Sending an email to registered users (for significant changes)
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
